Panamá Papers, un Modigliani y hasta la nieta de Picasso en el escándalo de obras robadas

Tras un descubrimiento –por casualidad– el nieto de un comerciante judío de arte supo que una valiosa pintura que se pensaba había sido robada de su abuelo, por los nazis, podría estar ahora en manos de una de las familias más influyentes del mundo del arte. En los archivos de una firma panameña están las respuestas a los intrigantes misterios que envuelven la obra pero ¿de qué obra hablamos? Sí, nada más ni nada menos que la obra del artista italiano Amedeo Modigliani conocida como “Hombre sentado con bastón”.

Modigliani que era un joven bohemio, muy alcohólico y que murió de tuberculosis hace casi un siglo, probablemente nunca pensó que sus pinturas se venderían hoy por más de $170 millones. El retrato donde sale un hombre elegante con bigote sentado en una silla y con las manos descansando sobre su bastón, puede valer hasta $25 millones ¿algo poco o no?

Los abogados del nieto enviaron una carta a la Galería Nahmad, en Nueva York, declarando que la pintura pertenecía al joven, quien estaba en su derecho de reclamarla, por lo que pidieron una reunión para discutir el asunto. La galería no respondió de acuerdo a los documentos de la corte, lo que provocó que el nieto los demandara. La demanda también fue justificada porque los investigadores rastrearon la pintura hasta un clan de billonarios que compró la obra en una subasta en 1996.

¿Y POR QUÉ ENTRA PANAMA PAPERS?

Tras el escándalo de las publicaciones de los Panamá Papers, se han revelado operaciones ilegales en el mundo del espectáculo, del deporte y políticos, pero hace unos días se supo que también existen en el mercado del arte. Esto afecta a los juicios de demanda por la propiedad de obras desaparecidas y que giran en torno a categorías de talla como Van Gogh, Picasso, Rembrandt y el caso de Modigliani… ¿¡Quién pensaría que las obras que pueden ser contempladas sólo por la historia, libros e internet estarían escondidas en manos de los más ricos del mundo y peor aún, ligados al arte!?

Pero ojo, la historia no termina aquí…

La familia de origen sirio, los Nahmad, han insistido en cortes federales y estatales en Nueva York que no poseen la obra de Modigliani, sino que es de una compañía offshore llamada International Art Center (IAC), registrada por una poco conocida firma panameña. Según los registros secretos obtenidos por el Consorcio Internacional de Periodistas de Investigación, el diario alemán Süddeutsche Zeitung y otros medios asociados, sugieren que esa declaración es un engaño legal diseñado para ocultar a los verdaderos poseedores de la pintura. Los registros que son más de 11 millones de documentos en total, vienen de los archivos internos de Mossack Fonseca, una firma panameña que se especializa en construir estructuras corporativas que pueden ser usadas para esconder bienes.

¡Desde 1977 hasta 2015, los archivos incluyen una gran cantidad de información sobre las conexiones entre el comercio internacional de arte y las jurisdicciones del secreto offshore!

No sólo la familia Thyssen-Bornemisza (cuya colección privada de arte constituye el núcleo del Museo Thyssen-Bornemisza de Madrid) aparece en los registros panameños Mossack Fonseca, también se registran coleccionistas de arte con compañías registradas que incluyen al magnate chino del entretenimiento Wang Zhongjun y la nieta de Picasso, Marina Ruíz-Picasso.

Lo que llevó a un joven a recuperar la obra que le pertenecía a su abuelo, más la investigación rigurosa de Panamá Papers, sacó a luz que Mossack Fonseca no sólo ayudó a los Nahmad a establecer IAC en 1995, sino que aprovechó a muchos de sus otros clientes para llevar a cabo, en secreto, altas transacciones de arte en todo el mundo (como Chagall, Matisse, Basquiat y Warhol). Se espera que 3.000 millones de dólares y 83 obras de arte se puedan recuperar con la investigación.
